SPOKEN ONCE — TERMS OF USE
Last Updated: September 26, 2026
Welcome to Spoken Once.
Spoken Once helps people preserve meaningful stories, memories, experiences, personality, and wisdom in their own voice.
These Terms of Use apply when you use SpokenOnce.com or Spoken Once services, including Free Previews, purchased Keepsakes, and gifts.
By using Spoken Once, you agree to these Terms.
1. What Spoken Once Does
Spoken Once helps you turn what you share into a private digital Keepsake.
A Keepsake may include your original audio, organized chapters, a written version of your story, photos, AI-generated imagery, a final reflection, and other supporting elements.
We may use artificial intelligence and other technology to transcribe, organize, format, and present what you share.
You provide the story. Spoken Once helps put it together.
2. Who May Use Spoken Once
Spoken Once may be purchased by adults. Children and teenagers may participate in or contribute to a Keepsake with the involvement and permission of a parent or legal guardian.
If another person participates in your recording, you are responsible for making sure they know they are being recorded and are comfortable participating.
Spoken Once may not be used to secretly or unlawfully record another person.
3. Your Content Belongs to You
You retain ownership of the recordings, stories, photos, reflections, and other content you provide to Spoken Once.
To provide the service, you give Spoken Once a limited, non-exclusive permission to host, store, copy, process, transcribe, organize, format, display, and otherwise use your content as reasonably necessary to create, maintain, and deliver your Keepsake and provide the services you request.
This permission does not transfer ownership of your content to Spoken Once.
We will not publicly publish your personal Keepsake content or use it in our advertising or marketing without additional permission from you.
4. You Are Responsible for What You Share
You are responsible for the content you provide to Spoken Once and for making sure you have the rights and permissions needed to record, upload, share, or otherwise use that content.
Personal stories may involve other people. You are responsible for respecting applicable privacy, recording, intellectual property, publicity, and other rights.
Spoken Once helps organize and present material provided by the storyteller. We do not independently verify whether statements made in a story are true.
AI-assisted organization or presentation does not mean Spoken Once endorses or verifies the storyteller's statements.
5. Using Spoken Once Responsibly
Please do not use Spoken Once to:
- break the law;
- secretly or unlawfully record another person;
- violate another person's privacy;
- infringe intellectual property or publicity rights;
- unlawfully defame another person;
- exploit, abuse, threaten, or unlawfully harass someone;
- impersonate another person in a deceptive or unlawful way;
- create or distribute unlawful sexual or exploitative material, including material involving minors;
- facilitate serious unlawful activity;
- introduce malware or interfere with the security or operation of Spoken Once;
- circumvent payment or access controls; or
- use automated systems in a way that abuses or disrupts the service.
Personal stories may naturally include difficult, adult, painful, controversial, or sensitive experiences. These Terms are not intended to prevent people from honestly telling the stories of their lives.
6. AI and Automated Processing
Spoken Once uses artificial intelligence and other automated technology to help create Keepsakes.
Depending on the feature, this may include transcribing recordings, identifying meaningful moments, creating chapters and titles, preparing written versions of stories, identifying themes, selecting moments for imagery, and creating supporting images.
We may use third-party technology providers to perform some of this processing.
AI and automated systems can make mistakes. Generated text, organization, imagery, or other elements may not always perfectly represent what you intended.
Your original recording remains the primary record of what you said.
Spoken Once does not currently create an AI clone of your voice as part of the service.
7. AI-Generated Imagery
Some Keepsakes may include AI-generated imagery inspired by moments in your story.
These images are supporting visual interpretations. They are not documentary photographs and may not accurately represent the people, places, objects, or events you described.
Personal photos you choose to upload are separate from AI-generated imagery.
8. Your Keepsake Is Private
Purchased Keepsakes are designed to be private and are not publicly listed by Spoken Once.
A Keepsake may be accessed through a private link.
Anyone who receives that link may be able to access the Keepsake and forward the link to someone else.
Please share your private Keepsake link only with people you trust.
Once you choose to share your Keepsake or downloaded files with another person, Spoken Once cannot control what that person does with them.
9. Your Downloads Are Yours to Keep
Where available, you may download your finished audio and Story PDF.
We encourage you to keep your own copies.
Downloaded files are yours to keep independently of the continued availability of the hosted Spoken Once page.
While we intend to provide reliable access to purchased Keepsakes, we cannot promise that any online service or hosted page will remain available forever.
10. Purchases
Prices and included features are shown before purchase.
Unless otherwise stated at the time of purchase, a Spoken Once Keepsake is a one-time purchase rather than a subscription.
Payments are processed through a third-party payment provider.
Spoken Once does not directly store your complete payment-card information.
Applicable taxes may be added where required.
11. Gifts
Spoken Once may allow you to purchase a Keepsake for someone else.
When purchasing a gift, you are responsible for providing accurate recipient information and for using recipient information appropriately.
Gift links are private and should be shared only with the intended recipient.
A gift may be used to create and permanently save the Keepsake associated with that purchase.
The person who creates a Keepsake using a gift is also subject to these Terms.
12. Free Previews
Spoken Once may offer Free Previews so people can experience part of the service before purchasing.
Free Previews may have different limits, features, storage, sharing options, or download options than purchased Keepsakes.
We may change the availability or features of Free Previews over time.
13. Refunds
We want you to be happy with your Keepsake.
We offer a Free Preview so you can experience Spoken Once before purchasing. If something isn't right with your purchased Keepsake, email us at hello@spokenonce.com and we'll work with you to make it right, including a refund when appropriate.
Nothing in these Terms limits any refund or consumer rights that cannot legally be waived.
14. Photos and Other Material
If you upload photos or other material, you retain ownership of what you provide.
You give Spoken Once the limited permission needed to store, process, display, and include that material in your Keepsake and provide the service.
You are responsible for making sure you have the rights and permissions needed to upload and use that material.
15. Keeping Spoken Once Available
We work to keep Spoken Once reliable and available.
The service depends on internet access and third-party technologies, including hosting, payment, email, storage, and artificial intelligence providers.
We cannot guarantee uninterrupted or error-free service.
We may modify, maintain, update, or temporarily suspend parts of the service when reasonably necessary.
If a problem affects a purchased Keepsake, contact us and we'll work with you to resolve it.
16. Spoken Once Content and Technology
Spoken Once owns or licenses the platform, software, site design, branding, logos, and original content we create for the service.
These rights are separate from your ownership of your own recordings, stories, photos, reflections, and other personal content.
You may not copy, reproduce, distribute, or exploit Spoken Once technology, branding, or original materials except as permitted by law or with our permission.
17. Not Professional Advice
Spoken Once is a storytelling and Keepsake service.
Nothing provided through Spoken Once is intended to be legal, medical, financial, mental-health, or other professional advice.
18. No Guarantees About Technology
Spoken Once is provided on an “as is” and “as available” basis to the extent permitted by law.
We do not guarantee perfect transcription, perfect AI output, uninterrupted availability, permanent online storage, or absolute security.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
19. Limitation of Liability
To the extent permitted by law, Spoken Once will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of the service.
To the extent permitted by law, Spoken Once's total liability relating to a claim will not exceed the amount you paid for the purchase giving rise to that claim.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
Nothing in these Terms limits liability that cannot legally be limited.
20. Responsibility for Claims Related to Your Content
If your content or your use of Spoken Once causes a claim against us because you violated these Terms, violated the law, or infringed another person's rights, you agree to be responsible for the resulting reasonable losses, costs, or expenses to the extent permitted by law.
This does not apply where the claim was caused by Spoken Once's own unlawful conduct.
21. Suspending or Ending Access
We may suspend or end access to Spoken Once when reasonably necessary because of fraud, abuse, security concerns, unlawful activity, serious violations of these Terms, or legal requirements.
Where appropriate, we'll try to resolve an issue before ending access.
22. Changes to These Terms
Spoken Once will continue to evolve, and these Terms may change with it.
When we make changes, we'll update the “Last Updated” date above.
If a change requires additional notice or consent under applicable law, we'll provide it.
23. Governing Law and Disputes
These Terms are governed by applicable United States law and the laws applicable to Spoken Once's principal place of business, without limiting any consumer protections that apply to you under the law where you live.
If a disagreement arises, we encourage you to contact us first so we can try to resolve it directly.
